Stat. \u00a7301.45(1g), a person is required to comply with reporting requirements if, by December 25, 1993 he or she meets any of the following qualifications:<\/p><p>\u00a0<\/p><table width=\"430\"><tbody><tr><td width=\"426\"><p>is convicted of a sex offense<\/p><\/td><\/tr><tr><td><p>in prison or on supervision for a sex offense or a comparable WI law<\/p><\/td><\/tr><tr><td><p>is found not guilty by reason of mental disease or defect, and is committed civilly under \u00a751.20 or under \u00a7971.17 for a sex offense<\/p><\/td><\/tr><tr><td><p>is in institutional care or on conditional transfer under \u00a751.35(1) or conditional release under \u00a7971.17 for a sex offense or a comparable WI law<\/p><\/td><\/tr><tr><td><p>is on supervision in this state from another state under \u00a7\u00a7304.13(1m), 304.135, or 304.16 for a violation of another state\u2019s law that is comparable to a sex offense<\/p><\/td><\/tr><tr><td><p>is a juvenile in this state on or after May 9, 2000, and is on supervision in this state from another state pursuant to \u00a7938.988 for a violation of another state\u2019s law that is comparable to a sex offense<\/p><\/td><\/tr><tr><td><p>is placed on lifetime supervision based upon his or her status as a serious sex offender under \u00a7939.615 on or after June 26, 1998<\/p><\/td><\/tr><tr><td><p>is in institutional care or on supervised release under ch. 980 on or after June 2, 1994<\/p><\/td><\/tr><tr><td><p>is ordered by the courts to comply with the reporting requirements of \u00a7301.45<\/p><\/td><\/tr><tr><td><p>was required to register under \u00a7301.45(1)(a), 1997 stats., based on a finding that he or she was in need of protection or services and is ordered to continue complying with the requirements of this section by a court acting under 1999 Wisconsin Act 89, section 107(1)(e)<\/p><\/td><\/tr><tr><td><p>is, on or after December 1, 2000, registered as a sex offender in another state, or with the FBI, and is a resident, student, or is employed in Wisconsin<\/p><\/td><\/tr><tr><td><p>has committed a sex offense in another state, and; on or after December 1, 2000, is a resident, student, or employed in Wisconsin, and; no more than 10 years has passed since the date he or she was released from prison \/ placed on parole<\/p><\/td><\/tr><\/tbody><\/table><p>\u00a0<\/p><p><strong>\u00a0<\/strong><\/p><p><strong>How long is a person required to report?<\/strong><\/p><p>\u00a0<\/p><p>According to Wis. Stat. \u00a7301.45(5)(a), a person is required to report under \u00a7301.45 for 15 years after the discharge of his or her probation or extended supervision for the sex offense, in most circumstances and for most sex offenses. \u00a0\u00a0In some situations, however, a person is required to report for the rest of his or her life.<\/p><p>The circumstances requiring a lifetime reporting requirement are listed in Wis. Stat. \u00a7301.45(am) and (b), including:<\/p><p>\u00a0<\/p><table width=\"443\"><tbody><tr><td width=\"439\"><p>Serious sex offenders as defined in \u00a7939.615<\/p><\/td><\/tr><tr><td><p>A person who has 2 or more convictions for a sex offense<\/p><\/td><\/tr><tr><td><p>First degree sexual assault<\/p><\/td><\/tr><tr><td><p>Second degree sexual assault<\/p><\/td><\/tr><tr><td><p>First degree sexual assault of a child<\/p><\/td><\/tr><tr><td><p>Second degree sexual assault of a child<\/p><\/td><\/tr><tr><td><p>Engaging in repeated acts of sexual assault with the same child<\/p><\/td><\/tr><tr><td><p>Sexual assault of a child placed in substitute care<\/p><\/td><\/tr><tr><td><p>A sexually violent person under ch. 980<\/p><\/td><\/tr><tr><td><p>Court ordered compliance until death<\/p><\/td><\/tr><\/tbody><\/table><p><strong>\u00a0<\/strong><\/p><p><strong>\u00a0<\/strong><\/p><p><strong>What are the exceptions?<\/strong><\/p><p>\u00a0<\/p><p>There are exceptions to the mandatory reporting requirement.\u00a0 One is not required to comply with reporting requirements if ALL of the following apply:<\/p><table width=\"446\"><tbody><tr><td width=\"442\"><p>The individual meets the criteria under 301.45(1g)(a)-(dd)64 based on a violation of one of the following: First degree sexual assault of a child, Second degree sexual assault of a child, Engaging in repeated acts of sexual assault of the same child, Sexual assault of a child placed in substitute care<\/p><\/td><\/tr><tr><td><p>The violation did not involve sexual intercourse by use of threat of force or violence or with a victim under the age of 12 years<\/p><\/td><\/tr><tr><td><p>At the time of the violation the person had not attained the age of 19 years and was not more than 4 years older or younger than the child<\/p><\/td><\/tr><tr><td><p>It is not necessary, in the interests of public protection, to require the person to comply with the reporting requirements<\/p><\/td><\/tr><\/tbody><\/table><p>\u00a0<\/p><p>\u00a0<\/p><p>\u00a0<\/p><p>\u00a0<\/p><p>\u00a0<\/p><p>\u00a0<\/p><p>\u00a0<\/p><p>\u00a0<\/p><p>\u00a0<\/p><p>\u00a0<\/p><p>\u00a0<\/p><p>\u00a0<\/p><p>\u00a0<\/p><p>It is important to keep in mind,\u00a0 however, that although one may not be required to report, a judge may nonetheless order a person to report, under certain circumstances (see below).<\/p><p>\u00a0<\/p><p><strong>Discretionary Sex Offender Registration<\/strong><\/p><p>\u00a0<\/p><p>The information provided thus far has addressed the circumstances under which one is mandated to report to the sex offender registry.\u00a0However, as has been mentioned, there are also situations where a court may, in its discretion, order registration at sentencing. Pursuant to Wisconsin statutes section \u00a7973.048(1m), violations of the following may be considered for discretionary registration:<\/p><p>\u00a0<\/p><p>Ch. 940 Crimes against life and bodily security<br \/>Ch. 944 Crimes against sexual morality<br \/>Ch. 948 Crimes against children<br \/>942.08 Invasion of privacy<br \/>943.01-.15 Certain crimes against property<\/p><p>\u00a0<\/p><p>A court may require a person to comply with the reporting requirements of \u00a7301.45 if a court determines that the conduct underlying one of the crimes listed above was sexually motivated <em>and <\/em>that it would be in the interest of public protection to have that person register. \u201cSexually motivated\u201d is defined in \u00a7980.01(5) as \u201cone of the purposes for an act is for the actor\u2019s sexual arousal or gratification or for the sexual humiliation of degradation of the victim.\u201d To determine whether registration would be in the interest of public protection, the court may consider any of the following:<\/p><p>\u00a0<\/p><ul><li>The ages of the person and the victim at the time of the violation<\/li><li>The relationship between the person and the victim<\/li><li>Whether the violation resulted in bodily harm to the victim<\/li><li>Whether the victim suffered from any mental illness or mental deficiency<\/li><li>The probability that the person will commit other violations in the future<\/li><li>Any other factor the court determines may be relevant<\/li><\/ul><p>\u00a0<\/p><p>Under this section, the court may also remove a person from sex offender registry.\u00a0 For example, a person\u00a0may be convicted of 4th Degree Sexual Assault of a\u00a0Minor (a misdemeanor), sentenced to a withheld sentence, and placed on probation for 2 years.\u00a0 The judge may then impose the sex offender registry, but will agree to take the person off registry when the person successfully completes probation without any substantial rules
